INDY OIL PRODUCT WARRANTY

1. In the event that any Indy Oil lubricant is of poor quality, defective, substandard or fails during the service life of the lubricant, G.U.D. Holdings (Pty) Ltd (“G.U.D.”) will, subject to the limitations explained below:

1. replace the lubricant; or
2. refund the price of the lubricant.

For the purpose of this warranty “Service Life” shall mean the Service Interval specified by the vehicle or machinery manufacturer for the specific application in which the lubricant was used.

2. Notwithstanding the above, if any physical harm to person or property is caused as a consequence of:

1. G.U.D supplying unsafe lubricant;
2. a failure, defect or hazard in any lubricant.

3. As set out in the Consumer Protection Act, G.U.D. will, to the extent liable in law and on the facts, pay for loss/damages resulting from that harm. G.U.D.’s obligations in terms of this paragraph will be limited to the duration of the Service Life of the lubricant unless the Consumer Protection Act requires otherwise.

5. G.U.D. will have the right not to provide the remedies set out above to the extent that the Consumer Protection Act does not oblige G.U.D. to do so in the circumstances of a particular case.

6. Contaminated products: G.U.D. will not be liable for any damages arising from contaminated products which has risen from improper storage of products or mixing with other chemicals/substances.
